Jan 04, Colombo: Sri Lanka’s Parliament will take breach of privileges action against the two opposition parliamentarians who attended the Court of Appeal proceedings Thursday (03) despite a ruling given by the Speaker that Courts cannot issue notices on Members of Parliament.

Tamil National Alliance (TNA) MP R. Sampanthan and Janatha Vimukthi Peramuna (JVP) MP Vijitha Herath responded to a notice issued by the Appellate Court for the members of the 11-member parliamentary select committee (PSC) that probed the impeachment motion of Chief Justice to appear before the court.

Deputy Speaker of Sri Lanka parliament Chandima Weerakkody said that special permission is needed for its members to give evidence regarding parliament proceedings and its committees outside parliament and these two MPs have not obtained such permission before they appeared before the Court of Appeal yesterday.

However, the Deputy Speaker has said that he doesn’t know whether the two MPs had given evidence before the Court or a sworn affidavit which could also be considered as evidence.

He said if the MPs have given any evidence in court on the parliamentary proceedings, action could be taken against them under Section 17 of the Parliamentary Powers and Privileges Act.

A censure motion could be brought on the two MPs on the grounds that they had undermined Parliamentary supremacy, or else they could be charged for contempt of Parliament, Weerakkody has said.

The other nine members of the PSC including the two opposition United National Party MPs did not attend the court’s hearing on the petition filed by the embattled Chief Justice Dr. Shirani Bandaranayake challenging the PSC report.
